    The “New” Discrimination Laws – Understanding and Preventing Emerging Bases for Claims of Discrimination and Harassment.  To quote Bob Dylan, “The Times They Are a-Changin.’”  According to the EEOC, charges of discrimination on traditional bases such as sex have decreased slightly between 1997 and 2016.  But charges of discrimination based upon retaliation, religious discrimination, and harassment have doubled in that time period.  Likewise, charges of discrimination based upon age and national origin have increased.  This presentation will cover how to recognize emerging claims of discrimination and harassment, including claims of accent as a proxy for national origin or race, religious practices, the use of arrest and conviction information in hiring, and the trend of federal courts to include gender identity and sexual orientation claims under Title VII’s prohibition on sex discrimination and harassment. 

    Michael Santo began practicing law in his home state of Michigan in 1992 after receiving his undergraduate degree from Michigan State University and his law degree from the University of Detroit. After graduating from law school, he fulfilled a life-long dream of moving to Colorado when he accepted a position with Dufford, Waldeck, Milburn & Krohn and later co-founded the firm of Bechtel & Santo with Betty Bechtel. Since 1994, Michael has focused his practice on defending companies in employment litigation.

    Counseling companies on day-to- day employment issues is also an important part of Michael’s practice. By helping employers develop sound personnel policies, Michael assists many Colorado companies, large and small, in minimizing the risk of employment-related litigation.

    In 2014, the board of trustees of the Colorado Bar Foundation invited Michael to become a fellow of the foundation, an honor restricted to no more than five percent of lawyers in Colorado.
