The Bermuda Triangle is an area in the Atlantic Ocean in which an unusually high number of ships and planes have disappeared. Because the interplay of three major employment laws—the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA) and workers’ compensation—is so complicated and fraught with problems, many HR professionals often refer to these three laws as the Bermuda Triangle of employment law. It is essential to know about and to understand the interplay of these laws to ensure legal compliance as well as to provide employees with the benefits and protections each law provides. We will discuss:
- The importance of recognizing and analyzing the interplay of the ADA, the FMLA and workers’ compensation laws
- Purposes of the three laws
- Enforcement authorities for each law
- Important areas of interplay between the three laws that employers need to consider when managing employee absenteeism
- Example of an employee absence involving the interplay of the ADA, the FMLA and workers’ compensation

The Colorado COMPS Orders, Healthy Families and Workplaces Act, and now the Colorado Family and Medical Leave Insurance Programs have added many new challenges and legal implications for employers. In this session we will be looking at each of these laws individually, how they are practically applied, and how they interact with each other as well as federal law.

About the Presenters
Jacqueline Guesno (Attorney at Law) and Jessica Reed-Baum (Attorney at Law)
Jessica Reed-Baum is an associate in the Denver, Colorado, office of Jackson Lewis P.C. Her practice focuses on representing employers in workplace law matters, including preventive advice and counseling. During law school, Jessica served as an associate editor for the University of Colorado Law Review, a research assistant to Professor Helen Norton, and a law clerk for both the University of Colorado’s University Counsel, and Office of Athletic Compliance. As a collegiate swimmer, Jessica was awarded Academic Athlete of the Year in 2012 and 2013.
Jacqueline R. Guesno is of counsel in the Denver, Colorado, office of Jackson Lewis P.C. She represents employers before federal and state courts and administrative agencies in matters involving alleged violations of the Americans with Disabilities Act, Title VII of the Civil Rights Act, Age Discrimination in Employment Act, the Family and Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), the Fair Employment and Housing Act, and the Colorado Anti-Discrimination Act.
Jacqui has served as lead trial counsel in 10 employment trials nationwide involving claims of gender discrimination, age discrimination, pregnancy discrimination, FMLA interference/retaliation, worker’s compensation retaliation, disability discrimination, race and national origin discrimination, retaliation and FLSA violations.
Jacqui has extensive experience in the courtroom because she began her career as a Colorado state public defender where she spent almost every day in the courtroom. She was a public defender for nine years and tried in excess of 70 trials including homicides, sexual assaults, assaults, robberies, burglaries, thefts, shaken baby cases and domestic violence cases.
Throughout her career, Jacqui has earned a reputation as a fierce, tenacious, and highly skilled advocate, who has achieved a high rate of success for her clients and in turn has earned the respect of state and federal judges and fellow attorneys.
