    The OFCCP and EEOC are focused on uncovering systematic discrimination in recruiting and hiring - and they are taking a long, hard look at employment tests as part of this effort. The agencies have brought back significant settlements where tests have caused a disparate impact on a protected group and the employer was unable to provide sufficient validation and proof of consideration of suitable alternatives.
    Learning objectives:
    - Understand practical implications and potential pitfalls of pre-employment tests.
    - Recognize how the use of pre-employment tests, particularly on-line pre-employment assessments, can unknowingly expose employers to liability
    - Take away practical, easy to understand, guidance for managing employment testing and navigating the resulting enforcement dangers.

    Michelle Duncan is a shareholder in the Denver, Colorado office of Jackson Lewis P.C. Michelle focuses her practice on representing employers in affirmative action and employment discrimination matters before the Office of Federal Contract Compliance Programs. Michelle joined the firm after working for nearly fourteen years as a trial attorney with the U.S. Department of Labor, Office of the Solicitor. She served in the National Office in Washington D.C. as well as in the Dallas and Denver Regional Offices.

    Lisa Marsh is an Attorney in the Denver, Colorado office of Jackson Lewis P.C. She is a member of the firm's Affirmative Action Practice Group where she represents management exclusively in all areas of affirmative action and EEO. Lisa assists clients with development of affirmative action plans, represents contractors in Office of Federal Contract Compliance Programs matter, defends contractors during OFCCP audits, and counsels employers on issues stemming from OFCCP regulations.
