    About the Presentation

    Pay Equity is here to stay. While the Trump Administration may dial down federal enforcement, many states and large cities are passing pay equity laws of their own, creating a patchwork of different – and often conflicting – requirements. Add to the puzzle that academics, compensation theorists, Hollywood stars, and women’s and civil rights groups are working together to “attack the gap.” Join us as we tie these developments together and chart the path ahead.

    About the Speaker

    Michelle Duncan is a Principal in the Denver office of Jackson Lewis P.C. Michelle is a member of the Affirmative Action Compliance and OFCCP Defense Practice Group, and the Pay Equity Resource Group. She represents employers in affirmative action and employment discrimination matters before the U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP), which oversees federal contractors. She assists employers in OFCCP audits and complaint investigations throughout the country.

    Michelle also regularly counsels clients on the design and implementation of company-wide AAP structures, applicant tracking systems, pre-employment tests and other compliance issues. She counsels clients on pay equity issues and directs pay equity analyses for employers in many industries, including higher education.

    Michelle joined the firm after working for nearly 14 years as a trial attorney with the U.S. Department of Labor, Office of the Solicitor. During her tenure with the U.S. Department of Labor, Michelle was widely regarded as a leading expert on OFCCP litigation. She litigated numerous OFCCP cases and provided ongoing counsel to high-level OFCCP officials.

    Michelle offers unique insights into current trends involving pay equity, the inner-workings of OFCCP and the Solicitor’s Office, as well as what she is seeing in audits today.
